This Privacy Policy explains how HytaleModding (“Organizer”, “we”, “us”) collects, uses, stores, and shares personal data in connection with the Hytale ModJam (the “Event”). It also explains the role of Clerk as a third-party service provider for user authentication and account management.

By participating in the Event, you acknowledge and agree to the data practices described in this Privacy Policy.

1. Data Controllers and Processors

1.1 HytaleModding

HytaleModding acts as the data controller for all personal data processed in connection with:

• Event participation
• Submissions
• Voting
• Judging
• Prize fulfillment
• Communications
• Compliance and enforcement

1.2 Clerk

We use Clerk as a third-party authentication and identity management provider. Clerk acts as an independent data controller or processor (as applicable) for personal data it collects directly in order to provide authentication, login, and account-related services.

Clerk’s processing of personal data is governed by Clerk’s own Privacy Policy and Terms of Service, and HytaleModding does not control how Clerk independently processes such data beyond what is necessary to enable Event participation.

2. Data Collected

2.1 Data Collected by Clerk (Authentication)

When you sign up or log in using Clerk, Clerk may collect and process:

• Email address
• Username or display name
• Authentication credentials (e.g., passwords, passkeys, OAuth identifiers)
• Account identifiers
• IP address and device-related information (for security and fraud prevention)

HytaleModding does not receive or store your authentication credentials.

2.2 Data Collected by HytaleModding (Event Operations)

HytaleModding may collect and process:

• Name, username, or alias
• Email address (as provided through Clerk or submission forms)
• Submission content and metadata
• Voting activity and verification data
• Event communications
• Prize fulfillment information
• Tax-related documentation where legally required
• Moderation, enforcement, and dispute-related records

3. Legal Basis for Processing

Personal data is processed on the following legal bases:

• Contractual necessity (to operate and administer the Event)
• Legitimate interests (fraud prevention, voting integrity, promotion, dispute resolution)
• Legal obligations (tax reporting, compliance with applicable laws)
• Consent, where required by law

HytaleModding uses personal data to:

• Authenticate participation eligibility
• Operate and manage the Event
• Accept, review, and judge submissions

Personal data may be shared only where necessary and proportionate, including with:

• Clerk, for authentication and account linking
• Event sponsors and partners, including Nitrado, strictly for prize fulfillment, verification, and legal compliance
• Service providers supporting infrastructure, security, or communications
• Legal or regulatory authorities, where required by law

We do not sell personal data.

6. International Data Transfers

Personal data may be transferred to and processed in countries outside your country of residence, including jurisdictions that may have different data protection laws. Appropriate safeguards are applied where required.

7. Data Retention

Personal data is retained only for as long as necessary to:

• Operate and conclude the Event
• Fulfill prizes
• Resolve disputes
• Comply with legal, tax, and regulatory requirements

Data may be anonymized or deleted once it is no longer required.
